These Terms of Service govern your use of curioden.com and any purchase you make from CurioDen. By using the site or placing an order, you agree to these terms. If you are ordering on behalf of a school, district, or company, you confirm you are authorized to bind that organization. Last updated: October 31, 2026.
1. About us and these terms
CurioDen sells ant habitats, ant farm kits, classroom STEM kits, and accessories through curioden.com to customers in the United States and Canada. These terms apply to retail orders and to wholesale orders unless a signed wholesale or distribution agreement says otherwise; in that case, the signed agreement controls where it conflicts with these terms.
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to place an order. You are responsible for the accuracy of the information you provide and for activity under your account. Notify us promptly at if you believe your account has been accessed without authorization.
3. Products and descriptions
We describe products as accurately as we can, including dimensions, materials, contents, and the age grade of 6+ with adult supervision. Colors and finishes can vary between production runs, and photographs are illustrative. Where a specification is not final, we label it as provisional or ask you to contact us for current information rather than publishing a placeholder as fact. Kits ship without live ants; no product sold on this site contains live insects.
4. Pricing and availability
Retail prices are shown in U.S. dollars and may change without notice. Wholesale prices are quoted per account and are valid for the period stated on the quote. If a product is listed at an incorrect price or with incorrect information, we may cancel or refuse the order and will refund any payment already received. Availability is confirmed when an order is accepted; backorders ship when stock is available at no additional freight charge.
5. Orders and acceptance
Your order is an offer to buy. Our order confirmation email is an acknowledgment, and acceptance occurs when we ship, or when we issue a written acceptance for a wholesale order. We may decline an order for reasons including pricing errors, suspected fraud, shipping restrictions, or an inability to verify payment or purchase-order authority.
6. Payment
Payment is due at checkout for retail orders, usually by card through our payment processor. Wholesale orders are invoiced against a purchase order; wire and ACH are accepted, and Net 30 terms may be granted to approved accounts. You are responsible for any duties, taxes, or customs charges that apply to your destination unless your quote states that those charges are included.
7. Shipping, title, and risk of loss
Shipping timelines, zones, and freight arrangements are described on the shipping and delivery page, which forms part of these terms. Title and risk of loss pass on delivery to the address you provide, or as otherwise stated in a written wholesale quote or agreement. We do not ship live ants to any destination.
8. Returns and refunds
Returns, refunds, and damaged-shipment handling are governed by the returns and refunds policy. Nothing in these terms reduces a right you have under applicable consumer law.
9. Educational use and safety
Our kits are observation and education products for ages 6+ with adult supervision. You agree to use them as described in the included instructions, to keep small parts away from children under 3, and not to release any insect outdoors. You are responsible for complying with state and local rules that apply to any colony you obtain from a third party; our live-ant shipping policy summarizes those rules for planning purposes and is not legal advice.
10. Intellectual property
The site, product photography, text, and CurioDen marks are owned by CurioDen or its licensors. You may not copy, scrape, or reuse site content for commercial purposes without written permission, except that you may reproduce product specifications and compliance documentation for internal procurement and evaluation.
11. Your submissions
If you send reviews, photographs, or teaching notes, you grant us a non-exclusive, royalty-free license to use them to operate and promote the site and our products. Do not send content you do not have the right to share, and do not send student photographs showing identifiable minors.
12. Prohibited conduct
- Accessing the site in a way that interferes with its operation or security.
- Scraping, data mining, or reselling site content without permission.
- Submitting false order, purchase-order, or resale-certificate information.
- Using the site to violate any law, including export-control, invasive-species, or consumer-protection law.
13. Third-party links and services
The site links to third-party pages, including government compliance sources and payment or carrier portals. We do not control those services and are not responsible for their content or practices. Your use of a third-party service is governed by its own terms.
14. Disclaimers
Products are provided with the documentation described on their product pages and any compliance documentation we can supply on request. We do not promise specific educational outcomes, test-score improvements, or colony longevity, because those depend on factors outside our control. To the extent permitted by law, the site is provided “as is,” and we disclaim implied warranties other than those that cannot be excluded under applicable consumer law, including implied warranties of merchantability and fitness for a particular purpose.
15. Limitation of liability
To the extent permitted by law, CurioDen is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost instruction time, or loss of data, arising from your use of the site or products. Our total liability for a claim related to a product is limited to the amount you paid for that product. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
16. Indemnification
You agree to indemnify CurioDen against claims, damages, and reasonable legal fees arising from your violation of these terms, your unlawful use of a product, or your infringement of a third party’s rights.
17. Governing law and disputes
These terms are governed by the laws of the United States and of the state in which CurioDen maintains its principal place of business, without regard to conflict-of-law rules. Before filing a claim, email with a description of the issue and the relief you are seeking so we can try to resolve it. If we cannot resolve it within 60 days, either party may pursue a claim in a court of competent jurisdiction as permitted by applicable law. Nothing here prevents you from bringing a claim in a small-claims court where that option applies.
18. Changes to these terms
We may update these terms by posting a revised version with a new “last updated” date. The terms in effect when you place an order govern that order. Continued use of the site after a change means you accept the revised terms.
19. General
If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events outside its reasonable control, including carrier strikes, weather, customs delays, or supply interruption.
